Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Little Steps LLC ("Little Steps," "we," "us," or "our"), a Colorado limited liability company. They govern your access to the Little Steps mobile application, website, and related services (collectively, the "Service").

1. Eligibility and accounts

You must be at least 18 years old and legally able to enter into this agreement. The Service is intended for adult family members and caregivers; children may not create accounts. You agree to provide accurate information, safeguard your credentials and devices, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless prohibited by law.

2. Family IDs and roles

A Family ID is a private shared space. A family creator or authorized manager may invite other adults, manage photos, set walking goals, and administer access. A loved one may also create a Family ID and, when offered, purchase or redeem access for the family. A valid family entitlement is shared across authorized members of that Family ID; family members should not be required to purchase duplicate access for the same family.

Family roles and administrative controls may evolve. You should invite only people you trust. We may assist with access disputes, but we are not responsible for resolving family disagreements or determining legal rights to family content.

3. Family content and permissions

You retain ownership of photographs, captions, and other content you submit ("User Content"). You grant Little Steps a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for technical display, transmit, and make User Content available to authorized family members solely as needed to operate, secure, maintain, and improve the Service. This license ends when the content is deleted from our active systems, except for temporary backups and legally required retention.

You represent that you have all permissions needed to upload and share User Content, including photographs and personal information relating to children or other people. You will not upload content that violates privacy, publicity, intellectual-property, or other rights. Authorized family members may be able to save or copy content; Little Steps cannot control what they do with copies outside the Service.

4. Walking and wellness features

Little Steps provides motivational and family-connection features. It is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency services. Walking goals and step counts may be incomplete or inaccurate. Consult a qualified healthcare professional before changing physical activity, especially if you have health concerns, and stop activity if you feel unwell.

5. Physical activity and assumption of risk

Walking and other physical activity involve inherent and sometimes unforeseeable risks. These may include falls; uneven or slippery surfaces; stairs; traffic; weather; poor lighting; animals; encounters with other people; overexertion; dehydration; aggravation of an existing condition; and serious medical events such as cardiac events, stroke, injury, disability, or death. Your health, surroundings, route, pace, and decision to participate are outside Little Steps' control.

You are solely responsible for deciding whether, where, when, and how to engage in physical activity. Use appropriate caution, remain aware of your surroundings, follow applicable laws, do not interact with the app while driving or when doing so would be unsafe, and seek professional medical guidance when appropriate. If you believe you are experiencing an emergency, stop using the Service and contact 911 or your local emergency service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS OF PHYSICAL ACTIVITY UNDERTAKEN IN CONNECTION WITH THE SERVICE, WHETHER KNOWN OR UNKNOWN, AND RELEASE AND WAIVE CLAIMS AGAINST LITTLE STEPS ARISING FROM YOUR PARTICIPATION IN THAT ACTIVITY, INCLUDING CLAIMS ALLEGING ORDINARY NEGLIGENCE. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL OR WANTON MISCONDUCT, OR ANY LIABILITY THAT CANNOT LAWFULLY BE WAIVED.

Little Steps does not select or inspect walking routes, supervise activity, monitor anyone's physical condition in real time, verify that a goal is medically appropriate, or dispatch emergency assistance. A notification, streak, goal, photo, or other reward is never an instruction to continue activity when conditions are unsafe or you feel unwell.

6. Subscriptions and free trials

Little Steps may offer auto-renewing monthly and yearly subscriptions. Our currently planned U.S. prices are $7.99 per month with no free trial, or $74.99 per year following a seven-day free trial for eligible new annual subscribers. The monthly plan is billed immediately. Actual availability, eligibility, trial duration, currency, taxes, and price are the terms displayed in the Apple purchase confirmation or applicable marketplace at the time of purchase, and those displayed terms control.

Unless you cancel before the end of a trial or current billing period, the subscription automatically renews and the marketplace charges the payment method associated with your account. You can manage or cancel an Apple subscription in your Apple Account subscription settings. Deleting Little Steps does not by itself cancel a subscription. Refunds and billing disputes for marketplace purchases are handled under the marketplace's policies and applicable law.

7. Pricing and plan changes

To the fullest extent permitted by law, Little Steps may introduce, modify, replace, repackage, or discontinue free or paid plans; change prices, billing periods, included features, storage or usage limits; and offer different prices, promotions, or features to different eligible groups, platforms, regions, or times. We will provide notice and obtain consent when required by law or marketplace rules. A price change will not create a retroactive charge and will take effect for an existing marketplace subscription only as permitted by that marketplace.

If you do not agree to a future price or plan change, your remedy is to cancel before the change takes effect. Certain previously free features may become paid, and paid features may be modified or removed, subject to applicable law and any commitments stated at purchase.

8. Referral, promotional, and complimentary access

We may offer referral codes, free months, trials, discounts, or complimentary accounts. Offers may be limited by account, Family ID, device, region, campaign, product, redemption count, or date; may require eligibility verification; may not be combined; have no cash value; and may be changed, suspended, or discontinued before redemption. Unless an offer expressly says otherwise, it cannot be sold or transferred.

We may deny or revoke promotional or complimentary access obtained through error, fraud, duplication, resale, manipulation, or violation of these Terms. We may correct an incorrectly applied entitlement, but we will not retroactively charge you without authorization. When promotional access ends, we may ask you to choose a paid plan; you will not be enrolled in an auto-renewing paid subscription without the purchase confirmation required by the applicable marketplace.

9. Acceptable use

You may not:

• use the Service unlawfully or to harass, exploit, threaten, or harm another person;
• upload content you do not have the right to share;
• attempt to access another family, account, system, or data without authorization;
• interfere with security, availability, or operation of the Service;
• reverse engineer, scrape, automate access to, or commercially exploit the Service except where law expressly permits it;
• introduce malware or use the Service for spam, fraud, or deceptive conduct; or
• circumvent subscription, referral, storage, family, or feature limits.

10. Our content and license

The Service, including its software, branding, illustrations, designs, and non-user content, belongs to Little Steps or its licensors and is protected by law. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service on supported devices for its intended purpose.

11. Service changes and availability

Little Steps is an evolving service. We may add, modify, limit, suspend, or discontinue any part of the Service; change technical requirements; impose reasonable storage or usage limits; or release features to selected users for testing. We may do so at any time, with notice when legally required. We do not guarantee uninterrupted availability, permanent storage, compatibility with every device, or preservation of every feature. Keep independent copies of important photos.

12. Suspension and termination

You may stop using the Service at any time and may request account deletion. We may suspend or terminate access when we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay an applicable fee, abused a promotion, or threatened the Service or another person. When practical, we may provide notice and an opportunity to remedy the issue. Provisions that by their nature should survive termination will survive.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." LITTLE STEPS DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, CONTINUOUS, OR THAT STEP COUNTS, NOTIFICATIONS, UNLOCKS, OR FAMILY CONTENT WILL ALWAYS BE ACCURATE OR AVAILABLE. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITTLE STEPS AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID LITTLE STEPS FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limitations do not apply where prohibited by law.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Little Steps harmless from claims, losses, and expenses arising from your unlawful use of the Service, your User Content, your violation of another person's rights, or your material violation of these Terms. This obligation does not apply to the extent a claim results from Little Steps' own misconduct.

16. Governing law and disputes

Colorado law governs these Terms without regard to conflict-of-law principles. Except where applicable consumer law permits otherwise, you and Little Steps consent to the exclusive jurisdiction of the state and federal courts located in Colorado. Before filing a claim, each party agrees to make a good-faith effort to resolve the dispute by written notice and 30 days of informal discussion.

17. Changes to these Terms

We may revise these Terms to reflect changes to the Service, pricing, business practices, or law. We will post the revised Terms with an updated effective date and provide additional notice for material changes when required. Changes apply prospectively. Continued use after revised Terms become effective constitutes acceptance where permitted by law; if you do not agree, you must stop using the Service.

18. Apple-specific terms

If you obtained the app through Apple, these Terms are between you and Little Steps, not Apple. Apple has no obligation to maintain or support the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you. Your use must also comply with the App Store terms and applicable third-party service terms.

19. General terms

These Terms and the Privacy Policy are the entire agreement regarding the Service unless separate written terms apply to a specific offer. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, sale, or transfer of the Service.
